PA Gives Contractors Direct Recourse Against Architects for Defective Design
There have been several substantial changes in Pennsylvania Construction and Design law in recent years. For instance, the Pennsylvania Supreme Court has held that contractors may sue architects directly for furnishing defective plans or specifications, even when they do not have a contract with the design professional. See Bilt-Rite Contractors, Inc. v. The Architectural Studio, 866 A.2d 270 (Pa. 2005). Before Bilt-Rite, contractors had no recourse against architects who provided defective plans, because they were not in contractual privity with the design professionals, who enter into separate contracts with the property owner.
